USER AGREEMENT

Please read the following terms to use the “ http://www.cotcast.ai/” website and mobile application (referred to as the 'SITE' in short).

ARTICLE 1:Contract Definitions

WEBSITE: The website and mobile application through which various services and content are provided within the framework defined by 'COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY,' hereinafter referred to as 'COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY.' It is an online platform and mobile application accessible from the online environment that offers a range of services and content.

MEMBER: Any natural or legal person who wishes to avail services/products from COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY through the WEBSITE, who completes the selected membership form accurately, whose membership is approved and accepted by COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY. In this agreement, these individuals will be referred to as 'MEMBER' shortly. Individuals who are 18 years of age or older can become members by accurately completing the relevant membership form on the WEBSITE with their valid identification details. Companies (Individuals and partners) wishing to become members, Collective Companies, General Partnerships, Limited Partnerships with Divided Shares, Limited Liability Companies, Joint Stock Companies, Cooperatives, and other institutions, whose legal representatives over the age of 18 with valid legal information can complete the relevant membership form on the WEBSITE accurately and become a MEMBER to perform transactions on behalf of their institutions.

USER: An internet user who visits the website cotcast.ai by availing or not availing services/products.

LINK: A link that enables access from the WEBSITE to another website, files, content, or from another website to the WEBSITE, files, and content.

CONTENT: All kinds of information, files, images, programs, numbers, prices, etc., visual, textual, and auditory images published on the WEBSITE and/or any other website or accessible there, as well as all kinds of brands, designs, logos, slogans, and similar content created by COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY.

MEMBERSHIP AGREEMENT: This contract is entered into electronically between COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY and natural and/or legal persons who will benefit from the commercial and personal services offered through the WEBSITE.

PERSONAL INFORMATION: Personal information of the Member used to access the WEBSITE for improvement, development, and/or within the framework of legal regulations, including the Member's identity, address, email address, phone number, IP address, the sections of the WEBSITE visited, domain type, browser type, visit date, time, pages accessed during the visit, Internet address of the website allowing direct connection to the WEBSITE, and more.

ARTICLE 2: Identity of the Sevice Provider

A-) The services offered on this WEBSITE are provided by ' COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY,' with its address at 'ÇİFTE HAVUZLAR MAH. ESKİ LONDRA ASFALTI CAD.KULUÇKA MRK. A1 BLOK NO: 151 /1C İÇ KAPI NO: B34 ESENLER/ İSTANBUL' (hereinafter referred to as 'COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY').

B-) Individuals or legal entities benefiting from these services or accessing the WEBSITE in any way are considered to have accepted the following terms of use. If the written terms are not suitable for you, please cease using the services.

ARTICLE 3:Subject of the Contract

The subject of this contract is to determine the terms and conditions for benefiting from the WEBSITE owned by COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY and the conditions of the services provided.

ARTICLE 4:Terms of Use

A-) The services offered on this WEBSITE are provided by COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY, and COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY is the legal owner of the WEBSITE. All rights regarding the usage and determination of the terms of benefiting from the WEBSITE belong to COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY

C-) Every individual and legal entity benefiting from the WEBSITE services and accessing the WEBSITE is deemed to have accepted all the amendments made by COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANYto these terms of use in advance.

D-) COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANYreserves the right to change or terminate any information, forms, content, and any service provided to users on this WEBSITE at any time.

ARTICLE 5:Provided Services

A-) The service provided through the WEBSITE includes presenting worldwide cotton prices to the 'USER,' reporting these prices comparatively, and making price predictions for upcoming periods by evaluating market, production, and other factors together.

B-) The 'USER' can acquire the offered product/service through the WEBSITE by accessing the information available.

C-) Some of the products/services provided to the 'USER' through the WEBSITE are subject to a fee, and the 'USER' can access this information by making a payment.

D-) The product/service provided by COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANYis solely an information platform, and neither COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY has any responsibility regarding the accuracy of this information nor are the provided details in any way an investment advice.

ARTICLE 6:Scope of Services

A-) The scope of the service to be provided by COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY through the WEBSITE includes the provision of services/products offered for sale at the cotcast.ai address owned by COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY; after the payment is made by the MEMBER. Clause 5, section 'B' is reserved.

B-) COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY is entirely free to determine the scope and nature of the services to be offered through the WEBSITE, and any changes it makes regarding the services will be considered in effect upon being published on the WEBSITE.

C-) In order to benefit from the services to be provided within the WEBSITE, users must possess the characteristics determined by COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY, which will be specified in the relevant section of the WEBSITE's content. COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANYis entirely free to determine these characteristics, and any changes it makes to these characteristics will be considered in effect upon being published on the WEBSITE.

B-) COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY is not responsible for the websites and content accessed through the links on the WEBSITE, and any damages that may arise from the use of these sites are the sole responsibility of USERS and MEMBERS. COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY reserves the right to restrict access to such linked websites, either with its written consent or at its discretion, and can terminate access to links that it does not approve of at any time.

C-) COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY continuously monitors the accuracy and currency of the information present on the WEBSITE. However, despite the efforts made, the information on the WEBSITE may lag behind actual changes. The material and information contained in the content of the WEBSITE are presented at the time they are submitted to the WEBSITE, and there may be discrepancies between the current status of the relevant service or information and the status presented on the WEBSITE. E-) USERS and MEMBERS acknowledge that files, information, and documents suitable for download and/or sharing on the WEBSITE may not be free from viruses, worms, trojan horses, dialer programs, spam, spyware, or other malicious and harmful codes or materials, and that the WEBSITE does not provide any guarantees in this regard. It is the responsibility of USERS and MEMBERS to fulfill all software and hardware requirements for the prevention of such malicious programs, codes, or materials, to ensure the accuracy of data inputs and outputs, and to perform necessary maintenance and updates. COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY is not responsible for any damages that USERS and MEMBERS or third parties may incur due to data inaccuracies or losses caused by such malicious programs, codes, or materials.

F-) USERS and MEMBERS shall not use the WEBSITE in a manner that disrupts public order, goes against general morality, harasses or disturbs others, violates the law, infringes upon the intellectual and copyright rights of others, or engages in spam, viruses, trojans, etc. Additionally, USERS and MEMBERS shall not engage in activities that prevent or hinder others from using the services, engage in activities that cause harm (spam, viruses, trojans, etc.), and shall not use the WEBSITE for any illegal or fraudulent purposes. They shall not use the WEBSITE with the intent to disrupt, modify, or reverse engineer the entirety or any part of the WEBSITE, including the database and content, nor shall they use damaging technologies or spread viruses on the WEBSITE. The WEBSITE shall not be used for any unlawful or fraudulent purposes.

However, for ultimate security, USERS and MEMBERS must provide their own virus protection systems and ensure necessary security measures are in place. In this context, upon entering the WEBSITE, USERS and MEMBERS acknowledge that they are responsible for any errors that may occur in their own software and operating systems, and for any direct or indirect consequences thereof.

H-) COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY reserves the right to change, cancel, reorganize, halt, or suspend all types of services, products, campaigns, etc. information available on the WEBSITE, as well as the conditions of using the WEBSITE and the information provided on the WEBSITE, without prior notice or warning. These changes become effective for all MEMBERS and USERS upon their publication on the WEBSITE. The use of the WEBSITE or access to the WEBSITE implies acceptance of these changes. These conditions also apply to other web pages linked from this WEBSITE. COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY shall not be held liable for any interruption, error, negligence, interruption, deletion, loss, delay in operation or communication, computer virus, communication error, theft, destruction, or unauthorized entry, alteration, or use of records arising from breaches of the agreement, tort, negligence, or other reasons.

I-) MEMBERS; are responsible for keeping their password confidential and shall not disclose their password to other individuals or organizations. The right to use the password belongs solely to the MEMBER. The security and confidentiality of the email address and password used by the MEMBER when registering for the WEBSITE are entirely the responsibility of the MEMBER. The MEMBER acknowledges that any transactions conducted using their email and password are considered to be performed by themselves and therefore, they are solely responsible for any claims and demands that may arise from third parties or authorized authorities against COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY, as well as for any damages that COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY may suffer.

J-) COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY, its collaborating institutions, COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY employees and managers, and authorized sellers of COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY are not responsible for the services provided by third parties and the content published by them on the WEBSITE. The accuracy and legality of information, content, visual and auditory images, and other intellectual and industrial property rights provided and published by third parties are the sole responsibility of those who perform these actions. COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY does not provide any guarantee regarding the security, accuracy, and legality of services and content provided by third parties.

K-) Users of the WEBSITE may only carry out transactions on the WEBSITE for lawful and personal purposes. The legal and criminal responsibilities for the actions and activities carried out by USERS and MEMBERS on the WEBSITE are their own. Each USER and MEMBER undertakes not to engage in any activity that would violate the rights of COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY and/or any third party. COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY shall not bear any direct and/or indirect responsibility for any damages suffered or that may be sufferd by third parties due to the activities of USERS and MEMBERS on the WEBSITE.

L-) COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY reserves the right to cancel the services provided to MEMBERS and USERS that arouse suspicion of unjust enrichment without prior notice to the MEMBER or USER, and in such cases, the MEMBER or USER shall not have any right to make any claims against COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY.

M-) The information, articles, images, trademarks, slogans, and other signs on this WEBSITE, as well as the protection programs related to industrial and intellectual property rights, page layout, and the presentation of the WEBSITE are owned by COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY or organizations from which COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY has obtained permission and license. Copying, modifying, publishing, sending, distributing, or selling, either partially or entirely, any type of database, website, software code, HTML code, or other codes related to the WEBSITE pages, as well as copying, modifying, publishing, sending, distributing, or selling the products, designs, images, texts, visual, auditory and other images, video clips, files, catalogs, and lists contained in the WEBSITE content, using online or other media, is prohibited.

N-) USERS and MEMBERS undertake not to reproduce, copy, distribute, process, or compete directly and/or indirectly with COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY in any way with respect to the aforementioned WEBSITE software, hardware, and content, and agree not to engage in these actions or other methods. USERS and MEMBERS are not entitled to resell, process, share, distribute, display, or allow others to access or use COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY's services, information, and copyrighted works. Partial copying, printing, processing, distribution, reproduction, and display of the information on this page is only possible for non-commercial personal needs and with the written permission of COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY.

O-) SUNRISE may use the information sent to it by USERS and MEMBERS through the WEBSITE in accordance with the provisions of the 'Privacy Policy,' 'Website Terms of Use,' 'Privacy Commitment,' and 'Personal Data Protection Policies.' SUNRISE may process and store this information on a database. Additionally, SUNRISE may use the identity, address, email address, phone number, IP address, sections of the WEBSITE visited, domain type, browser type, visit date, time, etc. of USERS and MEMBERS for statistical evaluation, announcement of campaigns, and personalized services. Personal information of USERS and MEMBERS will not be disclosed to real or legal third parties, except as required by authorized authorities or in the cases listed below. Personal data is rarely provided to third parties acting on behalf of SUNRISE or to those related to COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY's business in order to better process the original purposes of data usage or to provide better services in line with the purposes suggested by USERS and MEMBERS. COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY processes and protects MEMBER and USER data in compliance with Law No. 6698 on Protection of Personal Data and the GDPR regulation. Detailed information about the processing and protection of personal data of MEMBERS can be accessed at http://www.cotcast.ai/ .

P-) In cases where explicit authorization is not granted by COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY within the scope of these WEBSITE Terms of Use, COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY reserves all rights to its services, information, copyrighted works, trademarks, trade appearance, or any other assets and information provided by this WEBSITE.

R-) The parties acknowledge and declare that all computer records owned by COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY will be taken as the sole and genuine evidence in accordance with Article 193 of the Turkish Code of Civil Procedure, and that these records constitute an evidence agreement.

S-) The MEMBER acknowledges that they can manage their commercial electronic message preferences through the 'My Account' section under the 'Update Membership Information' part.

ARTICLE 8:Limitation of Liability

A-) COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY shall not be liable for any direct or indirect damages that may arise due to accessing the WEBSITE, using the WEBSITE, the information and other data, programs, etc. on the WEBSITE, the breach of contract, tort, or any other reason. COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANYshall not assume any responsibility for interruptions, errors, negligence, or disruptions resulting from the breach of contract, tort, negligence, or other reasons. By accessing this WEBSITE or linked websites, “cotcast.ai”, it is acknowledged that COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANYis not responsible for any liability, damage, or claim, including court and other expenses, arising from the use or visitation.

B-) Any MEMBER or USER who violates one or more of the provisions listed in this User Agreement will be personally liable for such violations in terms of both criminal and civil liability, and will not hold COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANYresponsible for the legal and penal consequences of such violations. Furthermore, in the event that the matter is brought into the legal domain due to such violation, COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY reserves the right to claim compensation from the MEMBER or USER for non-compliance with the user agreement.

ARTICLE 9:Right of Withdrawal and Refund

This Agreement pertains to a service that is instantly provided to the Customer in an electronic medium, and due to its nature, it is not eligible for a refund. Additionally, in accordance with Article 15 of the Regulation on Distance Contracts, the Customer does not have a right of withdrawal.

ARTICLE 10: Assignment of Agreement

COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY reserves the right to assign this agreement in whole or in part at any time without prior notice. However,USER and MEMBER cannot transfer this agreement or any part thereof to any third party. Any attempt to transfer in such a manner shall be considered invalid.

ARTICLE 11:Force Majeure

In cases legally recognized as force majeure, COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY shall not be obligated to perform this 'USER AGREEMENT' in a delayed manner or refrain from performing it. Such circumstances and similar events shall not be considered as delay, non-performance, or default on the part of COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY, and COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY shall not be liable for any compensation in relation to these events.

ARTICLE 12:Applicable Law and Jurisdiction

Any disputes arising from this 'USER AGREEMENT' shall be subject to Turkish Law, and the competent courts and enforcement offices of Istanbul shall have jurisdiction. COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY reserves the right to file a lawsuit in the country where the USER and MEMBER are located.

ARTICLE 13:Effect and Acceptance

This 'USER AGREEMENT' becomes effective on the date it is announced on the SİTE's content by COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY. USERS and MEMBERS accept the provisions of this agreement by using the SİTE. COTCAST ARTIFICIAL INTELLIGENCE TECHNOLOGY JOINT STOCK COMPANY reserves the right to make changes to the provisions of this agreement at any time. Changes will be published on the SİTE with version number and change date, and will come into effect on the same date.
